An Order is an Order

Today at the High Court, we addressed a case involving a mother's deliberate refusal to comply with a High Court Order regarding the father's access to the child.

The mother was found guilty and fined for her actions. In matters of contempt, it is crucial to establish intentional defiance of a Court Order.

We refrain from pursuing contempt charges in cases stemming from misinterpretation without a clear indication of bad faith. While Court Orders must be respected, it is equally important to exercise judgment and avoid burdening the legal system with unnecessary applications. Decency and discernment play a significant role in determining whether a violation was a deliberate act of defiance.
